Title IX Update

On January 9, 2025, a federal court vacated the 2024 Title IX Final Rule, which will
impact our institution moving forward. Last year Farmingdale State College adopted
a revised Title IX Grievance procedure that took effect August 1, 2024. As a result
of the court decision, we are now required to retire our 2024 procedure and reinstate
the Title IX Grievance procedure that was in effect from August 14, 2020, until July
31, 2024. A link to the procedure now in effect can be found below.
Farmingdale State College is committed to preventing and responding to all forms of
sex discrimination in its programs and activities, including harassment and sexual
violence. The shift back to our 2020 Title IX Grievance Procedure will lead to some
changes in how cases are processed. Additionally, some incidents of discrimination,
harassment, and misconduct that were covered by our 2024 procedure will no longer
be covered under the 2020 procedure. However, these incidences may be adjudicated
under other campus policies such as our Student Code of Conduct, Policy for Addressing Formal Complaints of Sexual Harassment Under the Title IX Regulation, employee disciplinary procedures, and Discrimination and Sexual Harassment Complaint Policy & Procedure.
We encourage all members of the FSC community to familiarize themselves with their
rights and responsibilities under Title IX and other civil rights laws. Employees
should be knowledgeable about their obligations to connect students and colleagues
with available resources and to report incidents of sex discrimination and harassment
to the Title IX Coordinator, where applicable. To support these efforts, the College
has developed several informational webpages:
- Title IX at FSC – provides information on the College’s policies, practices, services, and programs.
- Student Concerns Reporting Portal – allows for students, faculty, and staff to report concerns on a range of topics,
including Title IX, sexual harassment, sexual misconduct and other civil rights issues.
- Reporting Responsibilities - provides guidance to employees on fulfilling their reporting obligations.
- Bias Response at FSC - informs employees about their rights under Title IX and other civil rights laws.
